Terms of Use

We would request you to kindly read the terms of service carefully and consider these as the terms of agreement between you and us. This governs the use and access to the website and the services to you and your associates.

Think exam is an Online Examination System to streamline your preparation and performance. The terms will be liable to a customer the moment, the customer creates an account on the website. These terms are effective to timely amendments on the choice of the provider.

1. Services and Product
We agree to offer the customer an account on the online assessment platform using a private server. Considering an event of a planned change in the provider’s network or infrastructure, the provider shall make practical efforts in order to notify the customer in advance. You agree to provide accurate and updated identification information during the account registration. The customer is solely responsible for the entire content shared on their account and also agrees to promptly notify in case of an unauthorized use or breach of the account. We will not be responsible for any loss or damage arising from the failure to provide accurate information or impose account security.

The terms to provide service are between the provider and the customer. No third party recipient interference is permitted. The provider should respect the privacy of the content and take utmost care in order to safeguard any illegal usage. Service is dependent on factors that include the network, servers and other subsidiary tools. Considering a case in which the software behaves uneven and the user gets an error, our team will work to resolve the issue by earliest, understanding the critical nature of the exam related events.

2. Terms
The customer agrees to the service starting on the date of the subscription. The service is timely and when due for renewal, we will be informing the customer in advance about the renewal date. Customer will be provided a week’s time as the grace time and the customer is liable to cancel their account by requesting a termination of the subscription.

3. Usage Policy
  • A. Prohibited Content and Activities - Email spam- Not allowed for using our services to transmit email spam, junk mail, return address and mailing lists. Hacking – IP scanning, denial of service, or other residuals to the security breaches or attempts interfering service of other network or servers. Intellectual property- The intellectual rights are reserved along with the copyright, trademark, or the patent rights. Fraud, violation of privacy rights, dissemination of offensive context and any kind of illegal activities.

  • B. False Information - Your personal information including name, email and contact details shared should be correct. We have the authorization to block your account in case of any information mismatch.

  • C. Misuse of System Resources - Multiple accounts will not be accepted. If found multiple accounts under the name of a single organization, the first account will be served as your primary account. The prior created accounts will be blocked without any notice. The attempts of questions are restricted if it extends a particular number for a particular subscription.

  • D. Concurrency - The concurrency provided will be of the order of 10% of the monthly limit of the number of attempts - as per the plan enrolled by the customer. Think Exam is not responsible for any crashes / damages caused and shall bear no loss - whatsoever in case the concurrency is found to be more than 10%. Please ensure to discuss your exact exam usage - before conducting the exams.

4. Account Cancellation
You will be solely responsible for the cancellation of your account, data backup and deletion of information. The entire content from the panel will be deleted once instructed for the cancellation of the account.

5. Cancellation and Refund Policy
  • Cancellation Requests:

    • Customers are allowed to request cancellations of their transactions.
    • Cancellation requests must be submitted through the specified channels, such as contacting customer support or submitting a cancellation form on the website.
    • The customer must provide relevant transaction details for cancellation verification.
  • Cancellation Timeframe:

    • Cancellation requests will be processed within 15 business days/hours of receipt.
    • Cancellations requested outside of business hours or during holidays may be processed on the next business day.
  • Refund Policy:

    • Refunds will be issued according to the terms and conditions of the product or service purchased.
    • In case of cancellation, eligible refunds will be processed in the original form of payment used during the transaction.
  • Cancellation Fees:

    • Cancellation fees may be applicable based on the type of product or service purchased.
    • The amount of the cancellation fee, if any, will be clearly stated in the terms and conditions or during the transaction process.
    • The cancellation fee, if applicable, will be deducted from the total refund amount.
  • Non-Refundable Items:

    • Certain products or services may be marked as non-refundable.
    • Non-refundable items will be clearly stated during the transaction process, and customers will be notified of their non-refundable nature prior to completing the transaction.
  • Exceptions:

    • Exceptions to the cancellation policy may be granted in special circumstances at the discretion of the company.
    • Customers can contact customer support to discuss any exceptional cases.
  • Communication:

    • Customers will receive confirmation of their cancellation request via email or other specified communication channels.
    • Further communication regarding the cancellation process, refund status, or any additional requirements will be conveyed to the customer through the provided contact details.
  • Modifications to the Cancellation Policy:

    • The company reserves the right to modify or update the cancellation policy at any time without prior notice.
    • Changes to the cancellation policy will be effective immediately upon posting on the website or other relevant communication channels.
  • Technical Problem:

    • Transaction between Service partner and End user.
      In case of any problem, technical or otherwise , because of which the payments gets deducted out of the End User's account , the payment gateway also shows that the payment has gone through but Ginger Webs ERP shows it as a failed transaction , then the End User has to contact the Service Partner for resolution of this issue. If the Service Partner's bank account shows the receipt of the said money,the Service Partner can manually rectify the payment discrepancy. However if the Service Partner's bank account does not show receipt of money then the Service Partner would request the End User to contact the Payment gateway to resolve the issue.The decision of the Service Partner in this regard would be taken as final.
    • Transaction between Ginger Webs and Service Partner.
      In case of any problem, technical or otherwise , because of which the payments gets deducted out of the Service Partner's account, the payment gateway also shows successful payment but does not show in our official ERP the Service Partner needs to contact Ginger Webs for resolution of this issue. If Ginger webs' bank account shows receipt of money Ginger Webs, then the issue can be manually corrected by Ginger Webs'. However if Ginger webs' bank account does not show receipt of money, it would request the payment gateway to revert the payment back to the Service Partner as the transaction was not successful as Ginger Webs' account has not received the money transferred and it normally takes upto 30 days for the payment to be credited back to the Service Partner.
  • Multiple Payments:

    • If double or multiple payments happens and the payment gateway service clearly mentions it, Ginger Webs would refund the payment after confirmation of receipt of double or multiple payments in our account. Another option would be to adjust the amount to the future fee as per Payer's request.
  • Other Payments Issue:

    • Transaction between Service partner and End user.
      In all other cases where there is a discrepancy in the fee paid, the payer / end User has to directly contact the Service partner and the service partner's decision would be final.
    • Transaction between Ginger Webs and Service Partner.
      In case of Service Partner's payment discrepancy in the fee paid, the Service partner has to directly contact Ginger Webs and the decision of Ginger Webs would be final.

6. Governing Law
This agreement is designed and governed in reference to the laws of India any dispute shall be heard at the local administrative bodies.
